Workers’ Comp Process at DG Law

Obtaining a Primary Treating Physician

(1) Immediately upon your retaining a workers’ comp lawyer at our Firm, we mail our representation letter to the insurance adjuster and/or their defense attorneys.

(2) We immediately schedule your appointment as soon as possible with a Doctor that is on our side and who has an office that is within 15 miles of your residence or your employer’s office so it is not considered geographically undesirable and an unfair distance for you to have to travel per the Labor Code.

(3) Your primary treating Doctor (your PTP) must be a Doctor(s) that is within the Medical Provider Network (MPN) which is a list of Doctors provided by the insurance company retained by your employer.

(4) If your PTP (Primary Treating Physician) is not within the MPN, then we file with the Court what’s referred to as an Expedited Hearing which will force the defense adjuster to retain a defense attorney to show up in Court within 2 to 3 weeks of our Firm’s Petitioning the Court so we can argue in front of and convince the Judge assigned to your case to issue an immediate Order authorizing our Firm to obtain immediate medical control (OUR SUCCESS RATE TO GET JUDGES’ ORDERS TO OBTAIN MEDICAL CONTROL IS APPROXIMATELY 95%!) such that our Firm can schedule an appointment with any Doctor as your PTP (Primary Treating Physician) we choose for you, and we make sure he is on your side. Specifically, a Doctor that will put you out on Total Temporary Disability so that we can get your Temporary Disability Payments started as soon as possible (at a rate of 2/3rds of your average weekly salary which must be paid to you directly by either direct deposit or by check every 2 weeks). Please be patient to get your checks. Sometimes it will take longer to be received if the check is mailed to you. As you are well aware, the mail is slow.

Receive Workers’ Compensation Payments

(5) If this happens to you that your checks are untimely, notify our Firm immediately to let us know that you did not receive your TTD checks yet and we will call the defense attorney so that they send you your money due to you as soon as possible; All Payments, once your having been diagnosed by your PTP as TTD (Totally Temporary Total Disabled), Total Temporary Disability benefit checks must be paid to you for 104 weeks per the Labor Code, unless your PTP (Primary Treating Physician), puts you back on modified duties. If your PTP places you off of work (TTD: Totally Temporarily Disabled) and the insurance company stops or denies payments of your TTD benefits, our Firm will file an Expedited Hearing and go to trial to get your benefits started (retroactive/past due and/or currently due monies: OUR SUCCESS RATE FOR REINSTATING YOUR BENEFITS IS AT 100% – outcomes may vary from case to case and results are not guaranteed). If your Doctor/PTP happens to place you on modified duties, your employer must honor your restrictions per your PTP’s work status report. Your Doctor will hand you a copy of this work status report to give to your employer (give us a copy and maintain them for your records).

You’re entitled to Temporary Disability Benefits during the time that the doctor has you on disability. Insurance companies can be unreasonable in what they are offering, so retaining us as your attorney would work out to your favor.

Applying for State Disability

(6) If your claim is still being denied or delayed, you can still apply for EDD (State Disability) with the State of California. Our Firm will help you fill out the insurance claim portion of the EDD paperwork FREE OF CHARGE that you get from EDD. You will then take it give it to your PTP. He will fill out and sign this form for you to turn into the EDD office. It takes about 1 month for EDD to mail you a debit card.

Depending upon your reserves, These benefit payments from EDD can last up to 52 weeks, but can vary from person to person.
